It is that time of the year again. Election 2019 is here.
As you are aware, the Heretaunga Tamatea Settlement Trust holds elections for its trustees in 3-year rotational cycles. Below is the schedule of upcoming elections for the 2019 – 2020 years.

NOTICE OF ELECTIONS 2019 CALLING FOR TRUSTEE NOMINATIONS

Heretaunga Tamatea Settlement Trust (HTST) is the Post Settlement Governance Entity for Heretaunga Tamatea established to receive the redress negotiated by He Toa Takitini in settlement of the historical Treaty grievances of Heretaunga Tamatea against the Crown.

NOTICE CALLING FOR TRUSTEE NOMINATIONS

Nominations are hereby invited for Trustees positions to the Heretaunga Tamatea Settlement Trust (HTST) for the following marae:

  • -  Rākautātahi Marae

  • -  Ruahāpia Marae

  • -  Rūnanga Marae

  • -  Taraia Marae

  • -  Te Rongo a Tahu Marae

  • -  Waimārama Marae

  • -  Kairākau Marae

  • -  Kohupātiki Marae

  • -  Korongatā Marae

  • -  Mangaroa Marae

  • -  Pourērere Marae

  • -  Pukehou Marae

Nominations open on Monday 12 August 2019 and must be lodged with the HTST office by Friday 30 August 2019 at 1:00pm.

Eligibility criteria for candidates and for making nominations are set out in the Nomination Packs.

Nomination Packs are now available for collection from the HTST office at 960 Omahu Road, Frimley, Hastings, by phoning (06) 876 6506 / 0800 TAKITINI (0800 825 484) or by emailing election@heretaungatamatea.iwi.nz

ELECTIONS 2019

Pursuant to clause 2.3, Second Schedule of the Trust Deed, elections are to be held if more than one Trustee Nomination is received for the following marae:

  • -  Ruahāpia Marae

  • -  Rūnanga Marae

  • -  Taraia Marae

  • -  Te Rongo a Tahu Marae

  • -  Waimārama Marae

  • -  Kairākau Marae

  • -  Kohupātiki Marae

  • -  Korongatā Marae

  • -  Mangaroa Marae

  • -  Pourērere Marae

  • -  Pukehou Marae

Voting opens on Monday 9 September 2019 and closes at 1:00pm on Friday 4 October 2019.

Each marae with more than (1) one candidate is required to hold a publicly notified Election Hui between Monday 9 September 2019 and Sunday 15 September 2019

All adult members of the Heretaunga Tamatea Settlement Trust, which Marae has more than (1) one candidate in their Marae Electorate are eligible to vote in this election. Single nominations received require no election.

If you do not receive a Voting Pack by Monday 9 September 2019 and are a registered adult member in the relevant Marae Electorate, please phone the election Helpline on 0800 825 484.

Formal notification of all results will be advised by the Returning Officer on Friday 11 October 2019.

MARAE ELECTORATE NOMINATION First Schedule

2.3 Marae Electorate Nomination

Each applicant must select their Marae Electorate for the purpose of electing Trustees in accordance with paragraph 5 of the Second Schedule (of the Heretaunga Tamatea Settlement Trust – Deed of Trust). In selecting a Marae Electorate;

  1. a)  where an applicant affiliates to only one Heretaunga Tamatea Marae that applicant may only select that corresponding Marae Electorate as his or her Marae Electorate;

  2. b)  where an applicant affiliates to more than one Heretaunga Tamatea Marae the applicant may select only one corresponding Marae Electorate as his or her Marae Electorate; and

  3. c)  an Adult Registered Member may change their Marae Electorate at any time except for during an Election Period or within twenty-four (24) months of having previously selected a Marae Electorate.

CANDIDATE NOMINATION Second Schedule

1.1 Eligibility For Nomination:
To be elected as Trustee a nominee for appointment must:

a) b) as at the closing date for nominations, be recorded in the Heretaunga Tamatea Register as an Adult Registered Member of Heretaunga Tamatea; and not:

1. be an undischarged bankrupt;

2. have ever been convicted of an offence involving dishonesty as defined in section 2(1) of the

Crimes Act 1961, or an offence under section 373(4) of the Companies Act 1993 (unless that

person is an eligible individual for the purposes of the Criminal Records (Clean Slate) Act 2004);

1. be or have been disqualified from being a director of a company registered under the

Companies Act 1955 or the Companies Act 1993;

1. be or ever have been removed as a trustee of a trust by order of Court on the grounds of

2. breach of trust, lack of competence or failure to carry out the duties of a trustee satisfactorily;

1. be physically or mentally incapacitated to the extent that he or she is unable to perform the

duties of a Trustee;

2. be subject to a property order made under section 30 or 31 of the Protection of Personal

Property Rights Act 1988;

1. have been convicted in the last 10 years of an offence punishable by more than three years

imprisonment (unless that person is an eligible individual for the purposes of the Criminal

Records (Clean Slate) Act 2004); or

2. have been removed as a Trustee under paragraph 6.3 of this Schedule within the past three

years.

5.2 Elections on the basis of Marae Electorates:

Every Adult Member may vote for a candidate nominated in their Marae Electorate. Every Adult Member may exercise only one (1) vote.

3. 5.3  Candidates with most votes elected
The candidates in each election who receive the highest number of valid votes for the relevant vacancies will be elected as Trustees. If there is an equal number of votes for a relevant vacancy, then the successful candidate will be decided by the drawing of lots in a manner determined by the Chief Returning Officer.
3. 5.4  No elections where a single nominee for a vacancy:
In the event that there is no more than one (1) valid nomination of a Trustee for a relevant vacancy no election shall be necessary and the person or persons nominated shall be deemed to have been duly appointed.
Fourth Schedule
1.2.1  Method of voting:
A voting process conducted in accordance with this Schedule must be conducted by postal vote to a physical, electronic, and/or digital address as determined by the Trustees from time to time.
1.2.2  Eligibility to vote:
Those eligible to vote in accordance with this Schedule are:
1.a)  those Adult Registered Members identified on Heretaunga Tamatea Register on the closing date for voting; and
1.b)  subject to clause 7.2 of this Schedule, any other Adult Member of Heretaunga Tamatea and has on or before the closing date for voting, provided to the Chief Returning Officer an application for registration as a Member of Heretaunga Tamatea which complies with paragraph 2 of the First Schedule to this Deed.
